1. Agreement and eligibility
These Terms govern the U.S. free beta of ClearPose, operated by Gabriela Jareczek ("ClearPose," "we," or "us"). By using ClearPose, you agree to these Terms. You must be at least 18 years old and legally able to enter a contract. The beta is offered only for personal, non-commercial use in the United States.
2. General wellness software
ClearPose estimates camera-visible alignment and provides general posture-awareness prompts. It is not a medical device, medical advice, diagnosis, treatment, rehabilitation service, or a substitute for a qualified professional. It does not promise to prevent pain or injury. Stop using ClearPose if you experience discomfort and seek appropriate care for health concerns or symptoms.
3. Beta risks
ClearPose is pre-release software. Features may change or be removed, estimates may be incomplete or inaccurate, and interruptions, defects, or data loss may occur. Do not use or rely on ClearPose for medical, emergency, safety-critical, workplace-compliance, or accessibility decisions.
4. Account and security
A Google-connected account may be required. You are responsible for access to your computer and account and for promptly reporting suspected unauthorized use. Google authenticates you; ClearPose does not receive your Google password.
5. Free beta and future paid plans
ClearPose is currently offered as a free beta and does not require a payment card. Free beta access may be limited, changed, paused, or ended as the product is tested. If paid subscriptions are introduced later, the price, renewal terms, cancellation method, and payment processor will be shown clearly before purchase. A free beta does not automatically convert into a paid subscription.
6. License and ownership
We grant you a limited, revocable, non-exclusive, non-transferable license to install and use ClearPose for its intended personal purpose during the beta. ClearPose, its software, design, content, and branding remain owned by the operator and licensors. You may not sell, sublicense, bypass access controls, interfere with the service, introduce malicious code, violate another person's privacy, or reverse engineer protected portions except where applicable law expressly permits it.
7. Feedback
If you voluntarily provide feedback, you permit us to use it without restriction or payment to improve and operate ClearPose. Do not include camera images, payment credentials, passwords, or another person's private information.
8. Updates, suspension, and termination
We may update or discontinue beta features and may suspend access for security, legal, or misuse reasons. You may stop using ClearPose and request account deletion at any time. Provisions that by their nature should survive termination - including ownership, disclaimers, and liability limits - will survive.
9. Disclaimers and liability
To the fullest extent permitted by law, ClearPose is provided "as is" and "as available," without warranties of accuracy, fitness for a particular purpose, non-infringement, or uninterrupted operation. To the fullest extent permitted by law, ClearPose will not be liable for indirect, incidental, special, consequential, or punitive damages, or lost data, profits, or opportunities. Our total liability arising from the beta will not exceed the greater of $25 or the amount you paid ClearPose during the three months before the event giving rise to the claim. These limits do not exclude rights or liabilities that applicable law does not allow us to exclude.
10. Changes and contact
Material changes will be presented in the app or by email and may require renewed consent. If any provision is unenforceable, the remainder continues. These Terms are governed by applicable U.S. law without overriding mandatory consumer protections where you live.
